1. OVERVIEW

Welcome to Luminis Studio.

These Terms of Service (“Terms”) govern your access to and use of the Luminis Studio website, online store, products and related services (collectively, the “Services”).

Throughout these Terms, “Luminis Studio”, “we”, “us” and “our” refer to Luminis Studio, operated from Madrid, Spain.

Our online store is hosted by Shopify, which provides the e-commerce platform that enables us to offer our products and Services to you.

By accessing our website, using our Services or placing an order, you agree to these Terms and to our Privacy Policy. If you do not agree with these Terms, you should not use our Services.

Nothing in these Terms limits or excludes any mandatory rights granted to consumers under applicable Spanish or European Union consumer protection law.

2. ELIGIBILITY AND ACCOUNTS

By using our Services, you confirm that you have the legal capacity to enter into a binding contract under the laws applicable to you.

You may be required to provide certain information when placing an order, including your name, email address, billing information, payment information and shipping address. You agree to provide accurate, current and complete information.

If you create an account, you are responsible for maintaining the confidentiality of your account credentials and for activity carried out through your account.

3. PRODUCTS

Luminis Studio creates and sells design objects, decorative objects, sculptures, lighting and related products.

We make reasonable efforts to display our products, materials, colours, dimensions and finishes as accurately as possible. However, the appearance of colours and materials may vary depending on your screen, lighting conditions and device.

Many Luminis Studio pieces are produced using materials such as concrete, plaster, mineral materials and/or 3D-printed components. Due to the nature of these materials and production processes, minor variations in colour, texture, pores, surface characteristics, finish and other details may occur between individual pieces.

Such natural or production-related variations do not necessarily constitute defects where they are inherent to the material, manufacturing process or handcrafted character of the product.

Product descriptions, dimensions and specifications are provided on the relevant product page.

We reserve the right to modify or discontinue products and to limit available quantities, subject always to orders already accepted and applicable consumer law.

4. ORDERS

Placing an order constitutes an offer to purchase the selected products.

After you place an order, you will receive an electronic confirmation containing information about your order. We reserve the right to refuse or cancel an order where there is a legitimate reason to do so, including payment failure, suspected fraud, an obvious pricing or product information error, or product unavailability.

If we cancel an order after payment has been received, any amount paid for the cancelled order will be refunded.

Please review your order carefully before completing your purchase.

If you need to request a modification or cancellation, contact us as soon as possible at contact@studioluminis.com. We cannot guarantee that an order can be modified or cancelled once preparation or production has begun, without prejudice to any statutory rights you may have.

5. PRICES, TAXES AND PAYMENT

Prices are displayed in the currency indicated on the website.

For sales to consumers within the European Union, prices include VAT where required by applicable law, unless clearly indicated otherwise.

Shipping charges, where applicable, are displayed during checkout before the order is confirmed.

The final amount payable, including applicable taxes and shipping charges, will be displayed before you complete your purchase.

For eligible business-to-business transactions, VAT treatment may vary depending on the customer's location, VAT status and applicable tax rules.

Payments are processed through the payment methods made available at checkout. You agree to provide accurate and authorised payment information.

We reserve the right to change prices at any time. Such changes will not affect orders already accepted.

6. PRODUCTION AND PROCESSING TIMES

Some Luminis Studio products may be produced, finished or prepared after an order is placed.

Where applicable, estimated preparation or production times may be indicated on the relevant product page or during the purchasing process.

Production and processing times are estimates and may vary depending on the product, quantity and workload.

If a significant delay occurs, we will make reasonable efforts to inform you.

7. SHIPPING AND DELIVERY

We currently ship to the destinations made available during checkout.

Available shipping methods, shipping charges and estimated transit times are displayed during checkout.

Delivery dates and transit times are estimates unless expressly stated otherwise. Delays may occasionally occur due to carriers, exceptional circumstances, customs procedures where applicable, adverse weather or other circumstances outside our reasonable control.

For consumer purchases, risk of loss or damage remains with Luminis Studio until you, or a third party designated by you other than the carrier, take physical possession of the goods, except where applicable law provides otherwise.

If a parcel arrives visibly damaged, we recommend documenting the condition of the package and contacting us as soon as reasonably possible at contact@studioluminis.com .

8. RETURNS AND RIGHT OF WITHDRAWAL

If you are a consumer located in the European Union or European Economic Area, you generally have the right to withdraw from an eligible distance purchase within 14 calendar days without giving a reason.

For the purchase of goods, the withdrawal period generally begins on the day on which you, or a third party designated by you other than the carrier, physically receive the goods.

To exercise your right of withdrawal, you must inform us of your decision through an unequivocal statement before the withdrawal period expires.

Unless we agree otherwise or applicable law requires otherwise, the direct cost of returning the goods is borne by the customer.

Returned goods should be appropriately protected and packaged for transport. You may be responsible for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

Refunds will be processed in accordance with applicable consumer law and our Refund Policy.

Nothing in this section affects your rights regarding defective, damaged or non-conforming products.

9. CUSTOM AND PERSONALISED PRODUCTS

The statutory right of withdrawal may not apply to goods made to the consumer's specifications or goods that are clearly personalised, as provided by applicable consumer law.

This may include, for example, pieces specifically designed or materially modified according to individual specifications requested by the customer.

The fact that a standard product is produced or prepared after an order is placed does not, by itself, necessarily make the product personalised or exclude the statutory right of withdrawal.

Where a product is genuinely customised or personalised and the statutory withdrawal exception applies, this will be made clear to the customer before purchase where appropriate.

Your statutory rights regarding defective or non-conforming goods remain unaffected.

10. DAMAGED, DEFECTIVE OR NON-CONFORMING PRODUCTS

Please inspect your order after delivery.

If you believe that a product has arrived damaged, is defective, or does not correspond to what you ordered, contact us at contact@studioluminis.com with your order information and, where useful, photographs showing the issue.

Consumer purchases are covered by the statutory conformity protections applicable under Spanish and European Union law.

For goods sold to consumers under Spanish law, the seller is responsible for qualifying lack of conformity existing at delivery that becomes apparent within the legally applicable period, currently three years for new goods.

Any commercial guarantee we may voluntarily provide is additional to, and does not replace or restrict, your statutory consumer rights.

11. REFUNDS

Refunds are handled in accordance with our Refund Policy and applicable consumer law.

Where a refund is legally due following a valid exercise of the right of withdrawal, it will be made using the same payment method used for the original transaction unless otherwise expressly agreed, and without imposing additional fees on you.

Where permitted by law, we may withhold reimbursement until we have received the returned goods or you provide evidence that the goods have been sent back, whichever occurs first.

Additional delivery costs resulting from your choice of a delivery method more expensive than the least expensive standard delivery method offered by us may not be refundable where permitted by law.

12. INTELLECTUAL PROPERTY

Unless otherwise stated, the content of the Luminis Studio website and the original creative works displayed or sold through it—including product designs, sculptures, forms, models, photographs, videos, graphics, texts, branding and visual materials—are owned by or licensed to Luminis Studio and are protected by applicable intellectual property laws.

Purchasing a physical Luminis Studio product does not transfer any intellectual property rights in the design of that product.

You may not reproduce, manufacture, copy, commercially exploit, distribute or create unauthorised derivative works from our protected designs or content without prior written permission, except where such use is permitted by applicable law.

“Luminis Studio”, its visual identity and associated branding may not be used in a manner that falsely suggests affiliation, endorsement or authorisation.

13. WEBSITE USE

You may use our website only for lawful purposes.

You must not use the Services to:

violate applicable laws or regulations;
infringe intellectual property or other rights;
transmit malicious code;
attempt to interfere with the security or operation of the website;
collect personal information unlawfully;
impersonate another person or entity;
engage in fraudulent activity; or
use automated systems in a manner that disrupts, damages or places an unreasonable burden on the Services.

We may restrict access to the Services where reasonably necessary to protect the website, our customers or our legal rights.

14. THIRD-PARTY SERVICES AND LINKS

Our Services may contain links to or integrations with third-party services, including payment providers, delivery providers and other technology providers.

Third-party services are governed by their own terms and policies.

We are not responsible for independent third-party websites or services except to the extent that responsibility cannot legally be excluded.

15. SHOPIFY

Our store is hosted by Shopify.

Shopify provides the e-commerce infrastructure that enables us to offer the Services, but purchases made through our store are transactions directly between you and Luminis Studio.

Shopify is not the seller of Luminis Studio products.

Certain personal information may be processed by Shopify as described in our Privacy Policy and Shopify's applicable privacy documentation.

16. PRIVACY

Your personal information is processed in accordance with our Privacy Policy and applicable data protection legislation, including the General Data Protection Regulation (GDPR) where applicable.

Please review our Privacy Policy for information about how personal information is collected, used, stored and shared.

17. PRODUCT REVIEWS, FEEDBACK AND SUBMISSIONS

If you voluntarily submit a review, photograph, feedback, suggestion or other content to us, you confirm that you have the right to provide that material.

Where you grant us permission to use such material, we may use it for purposes related to Luminis Studio, including presentation or promotion of our products, subject to applicable law and any agreed limitations.

You must not submit unlawful, defamatory, infringing or misleading content.

18. ERRORS AND INACCURACIES

Occasionally, information on the website may contain typographical errors, inaccuracies or omissions relating to product descriptions, availability, pricing, promotions or shipping information.

We may correct such errors and update information where reasonably necessary.

Where an error materially affects an order that has already been placed, we will contact you where appropriate and respect your rights under applicable consumer law.

19. DISCLAIMER AND LIABILITY

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including mandatory liability arising under applicable consumer protection law.

We do not guarantee that the website will always be uninterrupted or free from technical errors.

To the maximum extent permitted by applicable law, we will not be liable for losses that were not reasonably foreseeable at the time the contract was entered into or that result from circumstances outside our reasonable control.

These limitations do not affect any mandatory rights or remedies available to consumers.

20. FORCE MAJEURE

We will not be responsible for delay or failure to perform an obligation where this results from circumstances outside our reasonable control, including serious transportation disruption, natural disasters, governmental measures, strikes, infrastructure failures or other comparable events.

Where such circumstances materially affect an accepted order, we will inform you where reasonably possible and take appropriate measures in accordance with applicable law.

21. SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will apply to the maximum extent permitted by law and the remaining provisions will remain in effect.

22. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, Refund Policy, Shipping Policy and any other policies expressly incorporated into them, constitute the terms governing your use of the Services and purchases from Luminis Studio.

Nothing in these Terms limits rights granted to consumers by mandatory applicable law.

23. GOVERNING LAW

These Terms and contracts entered into through Luminis Studio are governed by the laws of Spain, without prejudice to any mandatory consumer protection rights that may apply to you under the laws of your country of residence.

Where you are a consumer, nothing in these Terms deprives you of the protection afforded by mandatory provisions of applicable consumer law or any jurisdictional rights that cannot legally be waived.
